Terms and Conditions

The DataCamp Referral Program (“Program”) offered by DataCamp, Inc. (“DataCamp”, “we” or “us) has been created to reward you, our loyal customers, (“You”, or “Referrer”,) for doing what you would already do – recommending us to contacts who sign on to be DataCamp customers (“Referred Customers”). It was also created to reward your friends and family for listening to your great advice in referring us, by offering them a reward for signing up at your referral! To participate, Referrers must agree to the following Program Terms and Conditions (“Program Terms”), which become part of the DataCamp Terms of Use (“Terms of Use”). You represent and warrant that: (i) You have full legal authority to enter into these Program Terms; (ii) You have read and understand these Program Terms, and (iii) You agree to these Program Terms. If you do not have legal authority to enter into these Program Terms or do not agree to them, please do not click to accept these Program Terms below. Capitalized terms that are not defined here will have the same meaning given to them in the Terms of Use.

This Program is void where such referral programs are prohibited. Referrers may be eligible to receive gift cards in an amount of $9 for every qualified referral. Referrers must speak and read English, be legally able to participate in the Program, and must be 1) at least the age of majority where they reside but no less than 16 years of age, 2) have an existing, valid DataCamp Individual Plan account (i.e. paid monthly or annual subscription), and 3) are otherwise in good standing. When registering for the Program, Referrers must use the same email address that is registered with their existing Individual Plan Account. Sorry, no company accounts. DataCamp reserves the right to determine if a Referrer’s account is valid based on criteria that includes, but is not limited to, user account activity and ownership, incorporation status, and business affiliation of the user's registered DataCamp email address domain. Employees of DataCamp or its affiliates, including immediate family and household members, are not eligible.

How it works

Referrers can earn one (1) $USD 9 gift card for each referred contact that clicks on their unique referral link to create a valid paid monthly standard Individual Plan account that complies with our Terms of Use. The referred account must exist without refund for at least one paid monthly subscription. Gift cards will be sent through email from our third-party provider after all these conditions are met.

Reward Conditions. Rewards may be taxable, depending on the value of the item and the federal, state, and local tax laws applicable to the Referrer. Referrers are solely responsible for reporting such items on their tax returns and paying any associated tax liability.

Multiple Referrals. A referred contact may only use one referral link. If a referred contact receives referral links from multiple Referrers, only the Referrer associated with the referral link actually used by the Referred Customer will receive the gift card.

Conduct. Referrers must comply with all applicable laws. Referrals should only be used for personal and non-commercial purposes. Referral links should not be published or distributed on commercial websites (such as coupon websites, Reddit, or Wikipedia) or on blogs. Referrers are prohibited from “spamming” anyone with referral invitations. This includes mass emailing, texting or messaging people you do not know or using automated systems or bots through any channel to distribute your referral link. Referrers are prohibited from paying to advertise their referral links.

By participating in the Program, you also agree to the DataCamp Terms of Use (“Terms of Use”) and acknowledge the DataCamp Privacy Policy.

Release. Except where prohibited, by participating in the Program, Referrers release DataCamp, its affiliates and its and their respective directors, officers, employees, and agents (the “DataCamp Parties”) from any and all liability for any loss, harm, damages, cost, or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Program and/or the use of any Program rewards.

Indemnification. Refers agree to indemnify, defend, and hold the DataCamp Parties harmless from and against any and all third party claims, demands, liabilities, costs, or expenses, including attorney’s fees and costs, arising from, or related to any breach by the Referrer of any of these Program Terms or any violation by Referrer of applicable law.

Termination. DataCamp may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program or Program Terms at any time, without notice. DataCamp may, in its sole and absolute discretion, terminate or suspend any Referrer’s participation in the Program for breach of these Program Terms or taking any actions that are inconsistent with the intent of these Program Terms or Terms of Use. The amount and type of gift cards that you may obtain by participating in the Program can change at any time.

Participation in the Program may require a Referred Customer and/or a Referrer to submit personal information about themselves. The personal information will be collected, processed and used in accordance with DataCamp Privacy Policy.

DataCamp reserves the right to modify these Program Terms at any time, at its sole discretion, and without notice to You. If we modify these Program Terms, we will post the modification on the Site, which are effective upon posting. Continued participation in the Program after any modification shall constitute consent to such modification.

Other Terms

If any provision in these Program Terms are held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and not affect the validity of and enforceability of the remaining provisions. Except where prohibited, disputes, claims and causes of action arising out of or related to this Program will be resolved under the laws of the United States, and except where prohibited, New York law (without reference to its conflicts of laws principles), and Referrer agrees to submit any dispute to the exclusive jurisdiction of the state and federal courts located in New York City, New York.
